B. Scope of the processing of personal data via the Facebook fan page

Joint responsibility for data processing

We as the operator of the Facebook fan page and Facebook are jointly responsible for the data processing of the personal data of followers, fans, visitors and users that takes place on the fan page.

Information on data processing by our company can be found in our data protection information.

Information on the handling of personal data by Facebook can be found in their privacy policy.

You can access the agreement between us and Facebook on joint responsibility for data processing here: https://www.facebook.com/legal/terms/page_controller_addendum

You can also find a separate Facebook privacy policy for this Facebook fan page and the Insights function (see further information on Insights in the next section of this policy) here: https://www.facebook.com/legal/terms/information_about_page_insights_data

Use of Insights and cookies
In connection with the operation of the Facebook fan page, we use Facebook’s Insights function to obtain anonymized statistical data on the users of our Facebook page. For this purpose, Facebook stores a cookie on the end device of the user who visits our Facebook page. The cookie contains a unique user code and is active for a period of two years unless it is deleted beforehand. The user code can be linked to the data of users who are registered with Facebook.

The information stored in the cookies is received, recorded and processed by Facebook, in particular when the user visits the Facebook services, services provided by other members of the Facebook group of companies and services provided by other companies that use the Facebook services. In addition, other entities such as Facebook partners or even third parties may use cookies on Facebook services to provide services to companies advertising on Facebook. You can find more information on the use of cookies by Facebook in their cookie policy.

Purposes of processing
The purpose of processing the information is to enable Facebook to improve its advertising system, which it distributes via its network. On the other hand, it is intended to enable us as the operator of the Facebook fan page to obtain statistics that Facebook creates based on visits to our Facebook page. The purpose of this is to manage the marketing of our activities. For example, this enables us to learn about the profiles of visitors who like our Facebook page or use applications on the page in order to provide them with more relevant content and develop features that may be of greater interest to them.
In order to better understand how we can better achieve our goals with our Facebook page, demographic and geographical analyses are also created and made available to us based on the information collected. We can use this information to place targeted interest-based advertisements without obtaining direct knowledge of the visitor’s identity. If visitors use Facebook on multiple devices, the data can also be recorded and analyzed across devices if the visitors are registered and logged into their own profile.

The visitor statistics compiled are transmitted to us exclusively in anonymized form. We do not have access to the underlying data. Only Facebook itself has this access.

Legal basis and legitimate interests
We operate this Facebook fan page in order to present ourselves to and communicate with Facebook users and other interested persons who visit our Facebook fan page. The processing of users’ personal data is based on our legitimate interests in an optimized presentation of our company (Art. 6 (1) (f) GDPR).

Transfer of data
It is conceivable that some of the information collected may also be transferred outside the European Union by Facebook Inc. based in the USA. Facebook Inc. is certified under the U.S.-EU data protection agreement “Privacy Shield” and thus undertakes to comply with European data protection regulations.

We do not pass on any personal data ourselves.

Objection options
Facebook users can use the settings for advertising preferences to influence the extent to which their user behavior may be recorded when they visit our Facebook page. The Facebook settings or the form for the right to object offer further options.
The processing of information by means of the cookies used by Facebook can be prevented by not allowing cookies from third-party providers or those from Facebook in your own browser settings.

C. Rights of data subjects

If your personal data is processed, you are the “data subject” and you are entitled to the rights listed below.

The agreements with Facebook, including on joint responsibility, essentially mean that requests for information and the assertion of other data subject rights should be made directly to Facebook. As the provider of the social network and the possibility of integrating Facebook pages there, Facebook alone has direct access to the necessary information and can also immediately take any necessary measures and provide information.

If you still need our support, you can of course contact us using the contact details above.

The following applies to all your rights and requests:
If you contact us, we will answer your request ourselves to the extent that we are able to do so based on our own data processing and will otherwise forward your request directly to Facebook with the request to process it, as we have no insight into Facebook’s data processing.

Right to information
You have the right to obtain confirmation from us free of charge as to whether we are processing personal data concerning you. If this is the case, you have a right to information about this personal data and to further information, which you can find in Art. 15 GDPR.

Right to rectification
You have the right to obtain from us without undue delay the rectification of inaccurate personal data concerning you. You also have the right – taking into account the above-mentioned purposes of processing – to request the completion of incomplete personal data, including by means of a supplementary declaration.

Right to erasure
You have the right to obtain the erasure of personal data concerning you without undue delay where one of the conditions set out in Art. 17 GDPR applies.

Right to restriction of processing
You have the right to obtain from us restriction of processing where one of the conditions set out in Art. 18 GDPR applies.

Right to information
If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification or erasure of the data or restriction of processing, unless this proves impossible or involves a disproportionate effort.

You have the right to be informed about these recipients by the controller.

Right to data portability
You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and you have the right to transmit those data to another controller without hindrance from us, where the requirements of Art. 20 GDPR are met.

Right to object to processing based on legitimate interest
If, in exceptional cases, we process personal data on the basis of Article 6(1)(f) GDPR (i.e. based on legitimate interests), you have the right to object to the processing of your personal data at any time on grounds relating to your particular situation. If no compelling legitimate grounds for further processing can be demonstrated that outweigh your interests, rights and freedoms, or if the data in question is processed by you for the purpose of direct marketing, we will then no longer process your data (see Art. 21 GDPR).

A technical procedure that you use, e.g. a unique technical information that your web browser transmits to us (“do-not-track” message).

Right to withdraw consent
You have the right to withdraw your consent to the collection and use of personal data at any time with effect for the future. This does not affect the lawfulness of the processing carried out on the basis of the consent until revocation.

Automated decision-making, including profiling
You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. Unless the decision is necessary for the conclusion or performance of a contract between you and us, it is permissible on the basis of Union or Member State legislation to which we are subject and this legislation contains appropriate measures to safeguard your rights and freedoms and your legitimate interests, or the decision is made with your express consent.

We do not carry out such automated decision-making.

Voluntary nature of the provision of data
If the provision of personal data is required by law or contract, we will always point this out when collecting the data. In some cases, the data we collect is required for the conclusion of a contract, namely if we would otherwise not be able to fulfill our contractual obligation to you, or not sufficiently. You are under no obligation to provide the personal data. However, failure to provide it may mean that we are unable to perform or offer a service, action, measure or similar requested by you or that it is not possible to conclude a contract with you.

Right to lodge a complaint with a supervisory authority
Without prejudice to any other rights, you have the right to lodge a complaint with a supervisory authority for data protection at any time, in particular in the Member State of your habitual residence, place of work or place of the alleged infringement if you consider that the processing of personal data relating to you infringes data protection law.
